We, us – Mucklagh Community Centre, Company Limited by Guarantee

You - the buyer of the goods and aged 18 or over or competition entrant of any age with adult's permission

Contract - all orders placed by you on the Website are on the basis of these Terms and Conditions of Sale and are subject to acceptance by delivery of the goods to you at which point a legally binding contract is constituted between you and us.

These conditions override any other terms and conditions unless agreed by us in writing. If you deal with us as a consumer these conditions do not affect your rights. Any Contract and all Terms and Conditions will be governed by the laws of Ireland and the Irish Courts shall have jurisdiction. By using (browsing, registering, accessing) this website, you confirm that you have read, understood and agree to these Terms & Conditions in their entirety. Should you not agree to these Terms & Conditions in their entirety, you must not use the Website.

Data Privacy Policy
These Website Terms supplement (and are in addition to) the terms of our Data Privacy Policy.

Delivery
We use shipping partners to deliver orders typically within 2 – 5 working days. However, although we promise to despatch your order quickly, it should be remembered that delivery is not guaranteed within this timescale and parcels can occasionally take longer to reach their destinations. Click and collect products will be indicated as such at time of purchase.

Returns, refunds and cancellations
We offer a 14 day period to return unwanted goods, in line with the distance selling directive. Where goods are faulty or damaged in transit, you must inform us within 24 hours of receipt. All verified faulty or damaged goods are either replaced or refunded.

Limits of our Liability
(a) Goods are subject to manufacturers’ warranty only.
(b) Times quoted for delivery are approximate.
(c) We will not be liable for delays caused by circumstances beyond our control.
(e) We will not be liable to any person for any loss or damage which may arise from the use of or reliance on any content or information displayed in or on this Website nor will we be responsible for any error or inaccuracy in advertising and sponsorship material content that is displayed on the website.
(f) We will not be liable for any harm or damage to your computer or other device as a result of viruses or other harmful content that they access from or via the Website. You have the responsibility to ensure that your computer or device has the necessary protection against viruses and any other harmful or malicious content.

Ownership of Goods
We own any goods until you have paid for them in full. Until you have paid for all the goods received, you hold all goods supplied by us on trust for us. If you sell on any goods before you pay for them you must hold any money you receive for those goods in trust for us.

Terms and Conditions for Summer Camp Participation

1. Introduction:
The following terms and conditions govern the use of the Mucklagh Community Centre CLG (“Mucklagh Community Centre” or “the Organisation”) website, as well as the registration and booking procedures for the children's courses and summer camps. Participants and their guardians are advised to review these provisions thoroughly.
These terms and conditions are applicable to all children enrolled in the Mucklagh Community Centre Courses / Kids Camp. By securing a booking, parents or legal guardians express full acceptance of these terms and conditions, thereby waiving any claims inconsistent with the provisions detailed herein.

  • Camp Operational Information:

  • The operational hours of the course/camp are from 10:00 am to 1:00 pm daily.

  • Mucklagh Community Centre assumes no responsibility for children outside of these designated hours. It remains the exclusive responsibility of parents or guardians to ensure the punctual arrival and collection of their child at the specified location.

  • Participants are required to bring a packed lunch, appropriate rain attire, and sunscreen daily.

  • The use of mobile phones by participants is strictly prohibited during camp hours; all valuable items should remain at home.

  • Photographs and video recordings may be captured for promotional purposes. Should parents or guardians object to the use of their child's imagery, they must notify the Mucklagh Community Centre Kids Camp administration at the time of booking or via email.

  • Parents or guardians are required to supply a secondary emergency contact number on the booking application form.

  • To comply with health and safety regulations, participants may be required to remove footwear, socks, or headwear during specific activities.

  • Booking and Payment Procedures:

  • Places shall be allocated strictly on a 'first-come, first-served' basis.

  • Registrations will be finalized only upon receipt of a non-refundable deposit, in accordance with the rates published on the website.

  • A transactional booking fee of €3.00 shall apply to each transaction. This represents an administrative platform fee independent of the standard summer camp registration fees.

  • Eligibility is restricted to children between the ages of 6 and 12 years.

  • Cancellation and Refund Policy:

  • Pursuant to the Consumer Rights Act 2022, a statutory 14-day cooling-off period applies, whereby cancellations requested within 14 days of the initial booking date are eligible for a full refund.

  • Notwithstanding the foregoing, should the camp commence within this 14-day period, the transactional booking fee shall be non-refundable.

  • Enrollment and Application Requirements:

  • A parent or guardian must sign the enrollment form, indicating formal agreement to these terms and conditions.

  • The execution of payment to Mucklagh Community Centre explicitly constitutes full acceptance of these terms and conditions.

  • All pre-existing medical conditions must be comprehensively declared on the application form. By registering a child for Mucklagh Community Centre courses or camps, the parent or guardian warrants and confirms that the participant is physically capable of safely engaging in all activities and possesses no medical or physical contraindications. Parents or guardians bear full responsibility for disclosing relevant medical history and verifying their child’s readiness.

  • Liability and Indemnification:

  • General Waiver of Liability:

While all reasonable measures are implemented to safeguard the well-being of participants, Mucklagh Community Centre, along with its employees, volunteers, agents, and subcontractors, disclaims all liability for any personal injury, illness, loss, damage, or expense incurred by a participant or to their personal property, except in instances resulting directly from gross negligence or willful misconduct by the organization’s staff.

  • Acknowledgement of Inherent Risks:

Parents or guardians explicitly acknowledge and accept that involvement in indoor, outdoor, recreational, and group activities entails inherent risks. These include, but are not limited to, physical exertion, navigating uneven terrain, utilizing sports equipment, exposure to natural elements (such as insects and flora), and interactions with other participants. While minimized via structured supervision and safety protocols, these risks cannot be completely eliminated.

  • Medical Policies and Protocols:

Mucklagh Community Centre prioritizes the health and safety of all children. However, pursuant to Irish health and safety guidelines and internal policies, camp personnel are neither authorized nor qualified to administer medication to any participant; this restriction extends to all treatments, including but not limited to EpiPens.

Parents or guardians must ensure that any participant requiring medication (including EpiPens, inhalers, or other prescribed treatments) is fully competent in self-administration. Alternatively, a parent or guardian must remain on-site to provide direct supervision and administer necessary treatments.

In cases where a child is capable of self-administering medication, the treatment must be clearly labeled with the participant’s full name and accompanied by detailed written instructions from a parent, guardian, or medical practitioner.

Camp staff may assist in facilitating access to the child’s medication but will not administer it under any circumstances, as personnel are not medically trained. This policy remains absolute and applies to all participants, notwithstanding prior notification provided to the organizers regarding a child’s medical requirements.

In the event of a medical emergency, first aid may be administered by certified personnel. Where necessary, staff will secure emergency medical services or arrange transport to a medical facility. Every reasonable effort will be made to contact the parent or guardian immediately. The camp assumes no liability for medical expenses incurred due to emergency care or treatment.

The organization maintains a nut-free environment to optimize safety. However, the complete absence of nut traces in items introduced by other participants or external sources cannot be guaranteed, and guardians acknowledge the inherent risks of potential allergen exposure.

  • Personal Property and Valuables:

Participants are strongly discouraged from bringing valuables or non-essential personal items to the venue. The camp accepts no responsibility for the loss, theft, or damage of any personal belongings, including electronic devices, apparel, jewelry, or equipment brought to the premises.

  • Code of Conduct and Behavioural Incidents:

The camp shall not be held liable for injuries or damages resulting from a participant’s failure to adhere to safety rules, guidelines, or staff directions. Should a participant cause injury to another individual or damage to property through misconduct or negligence, their parent or guardian may be held financially and legally responsible for the arising consequences.

Mucklagh Community Centre reserves the right to remove any participant from the camp due to behavioral infractions, failure to adhere to regulations, or conduct that compromises the health and safety of others. In such circumstances where an individual is dismissed, no refunds will be issued, as operational costs will have already been incurred.

  • Engagement of Third-Party Providers:

  • Mucklagh Community Centre may engage third-party service providers (e.g., for specialized training or venue hire) as deemed necessary. Any such third party operates strictly as an independent contractor and shall not be considered an employee, agent, or legal representative of Mucklagh Community Centre.

  • Consequently, Mucklagh Community Centre assumes no liability for the actions, omissions, or services delivered by third-party providers, in the absence of an explicit contrary contractual agreement.

  • Insurance Coverage:

Mucklagh Community Centre maintains public liability insurance aligned with industry standards for all provided activities. This policy does not extend coverage to personal property, nor does it serve as a substitute for personal accident or medical insurance. Parents or guardians are advised to secure independent health or personal accident insurance coverage for their children if deemed necessary.

  • Force Majeure:

The organization shall not be held liable for any failure or delay in performing its obligations under these terms if such failure arises from circumstances beyond its reasonable control, including but not limited to severe weather conditions, public health emergencies, industrial action, natural disasters, or statutory government regulations.

  • Amendments and Modifications:

Mucklagh Community Centre reserves the right to amend, update, or modify these Terms and Conditions at its discretion without prior notice to address operational, legal, or safety requirements. Substantive amendments will be communicated to parents or guardians via email or published on the official website. Continued attendance at the camp following such updates constitutes formal acceptance of the revised terms.

  • Data Protection and Privacy:

All personal data collected by Mucklagh Community Centre Kids Camp will be securely processed and stored in strict compliance with applicable Data Protection Laws. Reference should be made to the organization’s Data Protection Policy for comprehensive details.

  • Severability:

Should any specific provision of these Terms and Conditions be deemed invalid, unlawful, or unenforceable by a competent authority, the remaining provisions shall continue to remain in full force and effect.

 

Subscriptions/Membership
Membership of Mucklagh Community Centre paid through this website is subject to the full rules of membership as outlined at the time of application. A membership application  does not guarantee acceptance.

Separate Terms, Waiver
If any term of this contract cannot be enforced, this will not affect the remaining terms. A decision by us not to enforce any of our rights will not prevent us from enforcing those or other rights we may have at a later time.

Changes to Website Terms and Policies
